I, Gabrielle Kirk McDonald, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal");

NOTING that the Appeals Chamber by a Scheduling Order issued on this day has ordered that Judgement in the present appeal will be delivered on Thursday 15 July 1999 at 9.00 a.m.;

NOTING that, due to exceptional circumstances, Judge Rafael Nieto-Navia will be absent from the seat of the International Tribunal on that date;

CONSIDERING that Sub-rule 15(E) of the Rules of Procedure and Evidence of the International Tribunal vests in me the power to authorise a Chamber to conduct routine matters, such as the delivery of decisions, in the absence of one or more of its members;

HEREBY AUTHORISE the Appeals Chamber, composed of Judge Mohamed Shahabuddeen, Presiding, Judge Antonio Cassese, Judge Wang Tieya and Judge Florence Ndepele Mwachande Mumba to deliver its Judgement in the absence of Judge Rafael Nieto-Navia.
