I, FLORENCE NDEPELE MWACHANDE MUMBA, Vice-President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991,

ACTING pursuant to Rule 21 of the Rules of Procedure and Evidence of the International Tribunal ("Rules") in the absence of the President,

NOTING that the Appeals Chamber, composed of Judge Mohamed Shahabuddeen (Presiding), Judge Antonio Cassese, Judge Rafael Nieto-Navia, Judge Florence Ndepele Mwachande Mumba and Judge David Hunt, is seised of this case,

NOTING that, by its Scheduling Order of 21 January 2000, the Appeals Chamber has set aside today, 31 January 2000, to deliver its Judgement in relation to proceedings commenced pursuant to Rule 77 of the Rules,

NOTING that Judge Antonio Cassese is absent from the seat of the International Tribunal today for personal reasons,

CONSIDERING that Rule 15 bis (D) of the Rules vests in the President the power to authorise a Chamber, in case of illness or an unfilled vacancy or any other similar circumstances, to conduct routine matters in the absence of one or more of its members,

HEREBY AUTHORISE the Appeals Chamber, composed of Judge Mohamed Shahabuddeen, Judge Rafael Nieto-Navia, Judge Florence Ndepele Mwachande Mumba and Judge David Hunt, to sit and to determine the Motion in the absence of Judge Antonio Cassese.
