 5             JUDGE FLUEGGE:  Good afternoon to everybody in the courtroom and

 6     to those listening to us.

 7             Mr. McCloskey, I see you're on your feet.

 8             MR. McCLOSKEY:  Mr. President, I realise we should probably go

 9     into closed session right off the bat.  Though, as we're -- before --

10             JUDGE FLUEGGE:  Before we go into closed session, I think there's

11     a reason for that.  I would like to raise the possible re-examination of

12     the last witness, Zoran Malinic.  There was some communication at the end

13     of last week, but you should put it on the record so that we have a clear

14     record on that.

15             MR. McCLOSKEY:  Yes, Mr. President.  We reviewed our thoughts and

16     our feelings about re-direct and decided it was not necessary, and we --

17     as you know, we sought authorisation to allow the witness to be released

18     and received that, and so he has been released, pursuant to your

19     authorisation.

20             JUDGE FLUEGGE:  And you waived your right for re-examination of

21     the witness.

22             MR. McCLOSKEY:  Absolutely, yes.  Yes.

23             JUDGE FLUEGGE:  Thank you very much.

24             If there are no other procedural matters, I have to tell the

25     public that we will hear witness in closed session today so that there is
