23                           [Open session]

24             THE REGISTRAR:  We are in open session, Your Honours.

25             JUDGE HALL:  This matter, Ms. Korner, of the videolink witnesses

Page 3466

1     for January.  The e-mail that you would have sent yesterday as to moving

2     those witnesses to the week following when we expected them, we just need

3     to have that formalised in a motion by you that the -- so that the

 4     necessary administrative --

5             MS. KORNER:  You mean, it simply won't do for us to arrange it?

6     We have actually got to file a motion to deal with that?

7             JUDGE HALL:  It can be done orally, certainly.

8             MS. KORNER:  I thought we had done that orally.  Oh, I see.  Oh,

 9     right.

10             Well, then, Your Honours, we formally apply to move the videolink

11     witnesses from the week that we had arranged, which I think was the week

12     of the 13th of January, to the following week.

13             JUDGE HALL:  So ordered.

14             JUDGE DELVOIE:  Ms. Korner, as from the planning for next week,

15     you gave us a series of witnesses, and now you are saying that

16     Mr. Trbojevic is coming the week after.

17             MS. KORNER:  Yes, that's what I told you this morning.  I just

18     gave his --

19             JUDGE DELVOIE:  Yeah, what day?  Monday?

20             MS. KORNER:  He is coming on the -- Tuesday, he will start

21     testifying on Tuesday, the 1st of December.

22             JUDGE DELVOIE:  Because the way I looked into the planning and

23     the estimate times, the witnesses you were speaking about this morning

24     will take more or less two weeks.

25             MS. KORNER:  No.  Your Honours, the witness who will start

Page 3467

1     tomorrow is 92 ter and will finish on Monday, we estimate.

2             JUDGE DELVOIE:  Yes.  Well, my calculation was that you would

 3     finish ST-113.

4             MS. KORNER:  113 is one hour in chief, and two hours

5     cross-examination all together.  So if does -- he is -- [overlapping

6     speakers]... cross tomorrow.  The next one ST-121 who is viva voce is

7     four hours in chief, three and a half in cross.  So that's seven and a

 8     half hours.  That's effectively --

9             JUDGE DELVOIE:  Ms. Korner, this is not the way we -- because you

10     can't follow this orally.  Should we exchange the data we have on those?

11     I'll ask the ALO to send you a mail.

12             MS. KORNER:  Yes, we'll do that.  And Your Honours, may I just

13     mention in passing very quickly, Your Honours, may feel in the light of

14     what arose this morning that it may not be a bad idea to have a 65 ter

15     conference at some stage to deal with where we are going effectively, and

16     what we have to do if we are going to have a problem over adjudicated

17     facts in particular.  But there are other matters I still think, which at

18     some stage perhaps we might deal with in such a conference.  It's just a

19     suggestion for Your Honours to consider.

20             JUDGE HALL:  I think we, ourselves, had thought so, Ms. Korner.

21             So we'll resume in an hour.

22                           --- Recess taken at 1.44 p.m.

23                           --- On resuming at 2.51 p.m.
