 2                           [Open session]

 3                           [The accused entered court]

 4                           --- Upon commencing at 2.20 p.m.

5             THE REGISTRAR:  Good afternoon, Your Honours.  Good afternoon,

6     everyone in and around the courtroom.  This is case number IT-08-91-T,

7     the Prosecutor versus Mico Stanisic and Stojan Zupljanin.

8             JUDGE HALL:  Thank you, Madam Registrar.

 9             Good afternoon to everyone.

10             May we have the appearances, please.

11             MS. KORNER:  Good afternoon, Your Honours.  Joanna Korner,

12     Belinda Pidwell, assisted by Crispian --

13                           [Trial Chamber and Registrar confer]

14             JUDGE HALL:  Sorry, Ms. Korner.

15             MS. KORNER:  I'll start again.  Joanna Korner, Belinda Pidwell,

16     assisted by Crispian Smith, case manager for the Prosecution.  Good

17     afternoon, Your Honours.

18             MR. ZECEVIC:  Good afternoon, Your Honours.  Slobodan Zecevic,

19     Slobodan Cvijetic, and Ms. Deirdre Montgomery appearing for Stanisic

20     Defence this afternoon.

21             MR. PANTELIC:  Good afternoon, Your Honours.  For

22     Zupljanin Defence today, Igor Pantelic, Dragan Krgovic, and

23     Miroslav Cuskic.  Thank you.

24             JUDGE HALL:  Well, inasmuch as the -- sorry, you're about to say

25     something.

Page 8921

1             MS. KORNER:  I've got various problematic administrative matters

2     to raise, Your Honours, before we get to the witness.

3             JUDGE HALL:  Before we go into closed session?

4             MS. KORNER:  Before, yes.  It can be done in open session.

 5             JUDGE HALL:  Yes.

6             MS. KORNER:  Your Honours, they really relate to the witness

7     who's due to follow this witness.  He's one of the victims of volcanic

8     ash.  I think you were alerted to it by Mr. Hannis yesterday or the day

 9     before yesterday, I can't remember which.  The latest e-mail we've had

10     from him is that there are no flights by which he can leave where he is

11     before Friday.  And where he is -- I don't think matters.  He's actually

12     in Croatia at the moment, which means he cannot be back here to start

13     testifying on Thursday which is when he's due to start.

14             In any event, he was due to arrive Wednesday.  There are -- he's

15     a witness who's got notebooks.  We disclosed the proofing note well in

16     advance.  The notebooks have to -- he was going to look at the notebooks,

17     and they will then have to be photocopied and given to the Defence.  So

18     he's got to be here at least half a day before he starts testifying.  So

19     the upshot of it is that we won't have a witness for Thursday and Friday

20     depending on how long this witness takes, and I'll come back to that.  I

21     have to deal with those matters in closed session.  Unless we put in

22     Ewa Tabeau; she's the only witness who's available.  And of course the

23     Defence have a motion outstanding objecting to her evidence.

24                           [Trial Chamber confers]

25             MS. KORNER:  Yes, I heard that.
