 2                           [Open session]

 3                           [The accused entered court]

 4                           --- Upon commencing at 9.04 a.m.

5             THE REGISTRAR:  Good morning, Your Honours.  Good morning

6     everybody in and around the courtroom.

7             This is case IT-08-91-T, the Prosecutor versus Mico Stanisic and

 8     Stojan Zupljanin.

9             JUDGE HALL:  Thank you, Mr. Registrar.  Good morning to everyone.

10     May we have the appearances, please.

11             MR. HANNIS:  Thank you, Your Honour.  And I note that again we're

12     just sitting with the two of you, I take it.

13             JUDGE HALL:  Thank you for reminding me, Mr. Hannis.  Yes.  For

14     the record, we reconvene again under Rule 15 bis, Judge Harhoff being

15     absent.

16             MR. HANNIS:  And for the Prosecution, Your Honours, I'm

17     Thomas Hannis, along with Matthew Olmsted and Crispian Smith.

18             MR. O'SULLIVAN:  Your Honour, Eugene O'Sullivan and

19     Deirdre Montgomery for Mr. Stanisic.

20             MR. KRGOVIC:  Good morning, Your Honours.  Dragan Krgovic,

21     Igor Pantelic, and Aleksandar Aleksic for Zupljanin Defence.

22             JUDGE HALL:  Thank you.

23             Before we go into closed session, the Chamber has an oral ruling.

24             The Trial Chamber is seized of a Prosecution motion -- and I

25     interrupt myself to say that there's a possibility the interpreters may

Page 14682

1     not have this, so I will speak as slowly as possible.

2             The Trial Chamber is seized of a Prosecution motion filed on the

3     14th of September, 2010, to amend the 65 ter list of exhibits by

4     reinstating one document, Rule 65 ter number 505, a dispatch from

5     CSB Banja Luka, dated the 4th of August, 1992, signed by the

6     Accused Zupljanin.  Yesterday, the Defence teams objected and the

 7     Prosecution replied orally.

8             The Chamber is satisfied of the prima facie relevance and

9     probative value of the document.  Given that the document was disclosed

10     to the Stanisic and Zupljanin Defence teams on the 13th of June, 2005,

11     and the 14th of October, 2008, respectively, and until May of 2008, it

12     was on the 65 ter list, it finds that the Defence have been on sufficient

13     notice and that no prejudice will be suffered by the Defence by adding

14     this half-page document to the Prosecution's 65 ter list of exhibits.

15             For these reasons and in the interests of justice, the Chamber

16     allows the addition of Rule 65 ter number 505 to the Prosecution's

17     exhibit list.

18             Thank you.  And we may now go back into closed session.

20                           [Open session]

21             THE REGISTRAR:  And we are back in open session, Your Honours.

22             MR. HANNIS:  Thank you, Your Honours.  We have finished sooner

23     than we anticipated.  Now, I know we talked yesterday about Ms. Korner

24     coming in and having some discussion about exhumations, et cetera.  I

25     don't know if she's aware that we've finished.  When we spoke at the last

Page 14755

1     break, it was anticipated we were probably going to take the rest of the

2     day to finish this witness.

3             My Case Manager's trying to reach her right now.  I don't know

4     what the Defence position is.

5             MR. ZECEVIC:  Well, I'm pretty sure that Ms. Korner assumes that

6     the amount of time that is left for us is nowhere near adequate for the

7     submissions as we anticipated.  So, therefore, I don't think we can start

8     the submissions today, but as scheduled tomorrow after the finish of the

 9     next witness.

10             MR. HANNIS:  The brief communication that my Case Manager's had

11     with Ms. Korner corroborates what Mr. Zecevic just said.

12             The next witness, ST-217, will be ready to start in the morning.

13             JUDGE HALL:  Thank you.  We will take the adjournment for today

14     and reconvene tomorrow morning in this courtroom at 9.00.

15                           --- Whereupon the hearing adjourned at 1.22 p.m.,

16                           to be reconvened on Friday, the 17th day

17                           of September, 2010, at 9.00 a.m.
