The status conference in the case against Dragan Zelenović, originally scheduled for Friday the 10 November has been moved to 23 November.
The proceedings in the Milutinović et al., Mrksić et al., Martić and Popović et al. cases will continue this week with proceedings in the Prlić case held only on Thursday.
Next week, the proceedings in the Milutinović et al., Mrksić et al. and Martić cases will continue Monday through Friday. The Prlić et al. case will continue Monday through Thursday and the Popović et al. case Wednesday through Friday.
Filings:
In the Šešelj case, the Prosecution filed a submission related to Šešelj’s submissions pertaining to special defence under the Rule 67 of the Rules of Procedure and Evidence. As you may remember, Šešelj raised this in the status conference held last week. According to the Prosecution, Šešelj submitted 15 such submissions; two were filed with the Registry and the rest directly with the Prosecution. The Prosecutions submitted to the Trial Chamber that the first of the 15 submissions was irrelevant to the issues in the case and nothing within the submission constituted a notification of a special case under the Rule 67. The Prosecution took a similar view in relations to subsequent submissions filed as special defence submissions.
In the same case, the Bureau dismissed two submissions by Šešelj, one for the dismissal of judges Orie, Moloto and Robinson, and the other to quash the practice direction on the length of briefs and motions. Bureau dismissed both submissions as being wrongly addressed to the Bureau.
In the case against Momcilo Krajisnik, the Appeals Chamber scheduled a status conference for 11 December 2006.
Office of the Prosecutor:
Anton Nikiforov, Advisor to the Prosecutor, made no statement.
Questions:
Asked whether the Prosecutor had seen the announcement in the Dutch Media regarding the Dutch Minister of Denfence’s intention to give a medal supposedly named the Genocide Cross to Dutchbat 3 and whether he had heard of the reactions across Europe and Bosnia, Nikiforov answered that he had no comment to give on that decision, and that it was an issue to address directly to the Dutch government itself.
Asked if clarification could be given on the Paris Match interview of Carla Del Ponte, Nikiforov replied that there is nothing to add to the initial reaction and that it had been decided not to comment any further on the matter.
