STATEMENT BY CARLA DEL PONTE, PROSECUTOR OF THE  INTERNATIONAL CRIMINAL TRIBUNAL FOR RWANDA

The Prosecutor welcomes the decision of the Appeals Chamber to revise its earlier decision and to allow the case against Jean-Bosco Barayagwiza to continue. The Prosecutor's Office will now proceed to prepare the case for trial.

The Appeals Chamber has now taken into account several new facts presented by the Prosecutor, namely: the fact that the appellant did know of the ICTR charges against him while he was in custody in Cameroon; the fact that Cameroon was not in a position to transfer him to the Tribunal for some considerable period; and the fact that after his transfer to Arusha the appellant and his counsel had agreed to the postponement of the initial appearance before the Trial Chamber.  Taking these decisive new facts into account, the Appeals Chamber rejected  Jean-Bosco Barayagwiza's motion for release.
 
No date has yet been fixed for the start of that trial, but in the meantime the Prosecutor expects that discussions will now resume between the prosecution and the defence on issues of evidence and procedure, with a view to having the case ready to proceed as a soon as possible.  Jean-Bosco Barayagwiza remains in custody in the Tribunal's Detention Unit in Arusha.
