Dragan Nikolic Pleads Guilty to all Four Counts of his Indictment

Today, Thursday 4 September 2003, Trial Chamber II comprised of Judge Schomburg, presiding, Judge Mumba and Judge Agius held a hearing to consider a confidential joint motion for consideration of Plea Agreement between Dragan Nikolic and the Office of the Prosecutor (OTP).

The Motion reflected a negotiated Plea Agreement whereby the accused would agree to plead guilty to all four counts of the fourth amended Indictment dated 4 September 2003 (the Indictment was amended during the motion hearing) and to the general legal allegations and additional facts as stated in the fourth amended Indictment.

Count 1: Persecutions on political, racial and religious grounds, a crime against humanity, punishable under Article 5(h) and Article 7(1) of the Statute of the Tribunal.

Count 2: Murder, a crime against humanity punishable under Article 5(a) and Article 7(1) of the Statute of the Tribunal.

Count 3: Rape, a crime against humanity punishable under Article 5 (g) and Article 7(1) of the Statute of the Tribunal.

Count 4: Torture, a crime against humanity punishable under Article 5 (f) and Article 7(1) of the Statute of the Tribunal.

Presiding Judge Schomburg read out the Indictment in its entirety. Dragan Nikolic entered guilty pleas to all four counts and the Trial Chamber filed a finding of guilt for all four counts.

The Office of the Prosecutor (OTP) recommended the Trial Chamber impose a sentence of 15 years. The Defence will make sentencing submissions at a later date.

The Sentencing Hearing has been scheduled to start on Monday, 3 November 2003 at 9.00 am.
