Matias Hellman, Registry Liaison Officer for Serbia, made the following statement:

On Monday afternoon, the President met with the legal advisers of the member States of the UN in New York. The meeting was also attended by Presidents of other international Tribunals. After briefing the legal advisers on the latest developments of the jurisprudence of the ICTY, the President addressed the issue of the current proliferation of international jurisdictions. Other matters related to the completion strategy were also mentioned. The President particularly stressed the importance of the support of member States in relation to the legacy of the ad hoc Tribunals. Since some of the Tribunal’s functions will have to continue beyond the conclusion of trials and appeals, the position of the Tribunal in this respect, as outlined in its Joint Paper with the ICTR on the Residual Functions of the ad hoc Tribunals, is to posit radically downsized Tribunals as a desirable residual mechanism.

The Outreach Programme is pleased to be hosting a visit by members of the Macedonian judiciary. The guests include ten judges from the Skopje Appellate Court and the Macedonian Supreme Court, as well as representatives from the Public Prosecutor’s Office, Higher Public Prosecution Skopje, Witness Protection Unit of the Ministry of Interior, Ministry of Justice, and the Academy for Training of Judges and Public Prosecutors. During the three-day visit, which started yesterday, the group will meet with representatives of the Registry, Chambers, OTP and Defence. This is the third group visiting the ICTY this year in the framework of a training program on international humanitarian law supported by the OSCE Spillover Mission to Skopje, the US Department of Justice, The Ministry of Justice of Macedonia and the Academy of Judicial Training in Skopje.

In terms of filings, on Monday the Prosecution as well as the defence for Mile Mrkšić and defence for Veselin Šljivancanin submitted notices of appeal against the judgement of 27 September in the Vukovar hospital case. The Prosecution did not appeal the acquittal of Miroslav Radić, which therefore became final.

SCHEDULE:

Today at 3:30pm the Appeals Chamber will pronounce its judgement in the case of Dragan Zelenović in courtroom III. As usual, we will issue a press release and the summary of the judgement right thereafter.

Next week, a Pre-trial conference for Vojislav Šešelj is scheduled for Tuesday, 6 November at 2:15 p.m. in courtroom I. The following day, the Prosecution is expected to give its opening statement at 9 a.m. and Šešelj will be given an opportunity to make a statement on Thursday, 8 November at 9 a.m. That will all be in courtroom I.

This coming Friday there will be two status conferences; in the Krajišnik case at 9 a.m. in courtroom I and in the Đorđevic case at 2 p.m. in courtroom III.

Questions:

A journalist asked whether the Prosecution decision not to appeal the Radić acquittal was the first time in the Tribunal’s history that the OTP had not appealed an acquittal. Hellman responded that it was not as in the Kupreškic case Dragan Papic was acquitted and that part of the judgement was not appealed.

In a follow-up question, the journalist asked for clarity as to why the Prosecution had decided not to appeal the Radić acquittal. In response, Kavran stated that the Prosecution carefully studied the Trial Chamber’s judgement and in particular the reasons it gave for acquitting Mr. Radić, and also looked carefully at the jurisprudence of the Appeals Chamber to date, especially with regard to the standard of review and made an estimation that an appeal would not be successful and therefore decided not to appeal.

Asked which particular aspects of the Radić case had lead to the decision not to appeal, Kavran reiterated what she had said earlier and that she was not able to elaborate.

Asked to clarify whether the statement Sešelj is scheduled to give at the start of his trial next week was to be seen as a statement by the accused or the opening statement of the defence, Hellman made clear that it would be a statement by the accused under Rule 84bis. Asked to confirm that Sešelj would therefore still be able to make an opening statement at the beginning of his defence case, he said that that was his understanding.
