ICTY Weekly Press Briefing - 2 May 2012

Date:  2.05.2012
Time: 11:00

Registry and Chambers:

Nerma Jelačić, Spokesperson for Registry and Chambers, made the following statement:

Good morning,

I’ll move straight to an update on the courtrooms. Proceedings in the trial of Radovan Karadžić and Jovica Stanišić and Franko Simatović continue this week as scheduled.

In the Karadžić case, the Prosecution is to call its last witness this week. The Chamber is currently hearing the testimony of Ewa Tabeau, an expert demographer. Within a week of the close of the Prosecution case, the Accused will present his submissions under Rule 98bis of the Tribunal’s Rules of Procedure and Evidence. This rule allows for the Trial Chamber to enter a judgement of acquittal on any count by oral decision at the close of the Prosecution case if there is no evidence capable of supporting a conviction. The Defence has until 27 August 2012 to file its list of witnesses and exhibits. The Defence case is scheduled to start on 16 October 2012, following a Pre-Defence Conference on 15 October.

In the Stanišić and Simatović case, Simatović’s Defence case resumed yesterday with the testimony of expert Defence witness Milan Milosević. This witness will resume his testimony this afternoon.

A Status Conference in the re-trial of Ramush Haradinaj and others will be held this afternoon at 14:15 in Courtroom III. All three defence teams have informed the Chamber that they will not be filing a motion for acquittal in accordance with Rule 98bis of the Rules of Procedure and Evidence. Ramush Haradinaj and Lahi Brahimaj have confirmed that they do not intend to present a defence case. Idriz Balaj will also not present a defence case subject to an agreement with the Prosecution concerning medical evidence. In the absence of such an agreement, if necessary a limited defence case will be presented on this matter.

Finally, the Pre-Trial Conference in the case of Ratko Mladić will resume tomorrow morning at 9:00 in Courtroom III.
