Refik Hodzić, Spokesman for Registry and Chambers, made the following statement:

The President of the Tribunal will travel to New York, where on Monday next week he will be presenting the annual report of the ICTY to the General Assembly of the United Nations. President Pocar travelled to London on Monday where he met with the officials of the Foreign Office to discuss issues of cooperation.

SCHEDULE:

The coming days will be quiet in the courtrooms. As you possibly already know, the proceedings in the Mrkšić et al trial have been cancelled for the rest of this week. The trial will pick up again next Monday at 14:15 in courtroom I and then move to courtroom II for the rest of the week. The Trial Chamber in Popovic et al case is conducting a site visit this week, while the proceedings in Milutinovic et al and Martic will also continue next week. The proceedings against Prlic et al will continue as scheduled. The Margetic initial appearance, originally scheduled for tomorrow afternoon, has been postponed. There is no further information at present, but I should have more for you in due course.Looking ahead to next week, there will a status conference in the Perišić case next Wednesday at 8:00 in courtroom II. The accused will not be present as he is on provisional release. On 13 October at 10:00, a status conference in the case of Ramus Haradinaj, Idriz Balaj and Lahi Brahimaj will be held in the courtroom III. On the same day, an 11 bis hearing will be held in the case of Dragan Zelenovic.

Filings:

The President of the Tribunal yesterday assigned ad litem judge Franck Höpfel for pre-trial work in the case of Vojislav Seselj. Judge Höpfel was appointed ad litem judge in the case of Milan Martic in November 2005.

The Appeals Chamber in the case of Radoslav Brdjanin has scheduled appeals hearings for 7 and 8 December. In the case of Naser Oric, the Appeals Chamber has ordered the defence to re-file its notice of appeal by 16 October finding that the Notice of Appeal filed on 31 July 2006 does not conform to the Rule 108 of the Rules and, in particular, Article 1 of the Practice Direction on Formal requirements.

Office of the Prosecutor:

Anton Nikiforov, Advisor to the Prosecutor and acting Spokesperson of the Office of the Prosecutor (OTP), made no statement.

Questions: Asked whether there was any new information from the authorities in Belgrade concerning the search for General Mladic, Nikiforov answered that all possible details of the plan to apprehend Mladic were discussed during the Proscrutor’s visit to Belgrade with co-ordinators, prosecutors, deputy prosecutors, two chiefs of special services, with Lajic and other politicians. He added that he was not at liberty to say whether there was any new information or not as the prosecutor still had to make her assessment, if requested, for the European Union. There was no date set for that so far and he could not comment further until the assessment was made.A journalist asked whether the prosecutor had provided the Belgrade authorities with any new data on Mladic’s whereabouts. In response, Nikiforov explained that the Prosecutor’s Office only had four investigators/ analysts in the so-called tracking unit working on locating all remaining fugitives. The OTP has no troops on the ground searching for fugitives. He added that the prosecutor provided analytical assistance in regard to all information gathered by the local authorities, who are supposed to lead the effort. The Prosecutor’s Office shared all information with the local authorities as had always been the case. This process had intensified in the past months. Asked whether the transfer of Stakic was being held up by translation problems, Hodzic responded that he had no comment. He added that the Tribunal never discussed a transfer until after it had taken place.On a technical matter, a journalist asked for clarification on Judge Höpfel’s position as pre-trial judge working on the Seselj case. Hodzic explained that Judge Höpfel was assigned by the President of the ICTY to work with Judge Orie on pre-trial issues in that case. He made it clear that Judge Höpfel was not part of the Trial Chamber for the Seselj case but that, according to the resolution governing the work of ad litem judges, he was being assigned for the purposes of pre-trial work.
