Good afternoon,
 

Welcome back after the Tribunal’s winter recess. I would like to take this opportunity to wish everyone a Happy New Year.
 

I will first highlight several developments in the Tribunal’s ongoing cases.
 

The Trial Chamber in the case of Ratko Mladić ordered on Monday that the presentation of the Rule 98bis submissions would commence 'on the 10th working day' after the official closure of the Prosecution's case. Both parties, the Prosecution and Defence, would be granted one court day for submissions, and each party will have one hour for replies. The exact dates of the presentation of the Rule 98bis submissions will be announced in due course.  

Also in the Mladić case, the Defence yesterday filed a motion before the Karadžić Chamber requesting the Chamber to reconsider its decision that denied Mladić 's motion for certification to appeal the subpoena decision, and to defer his testimony in the Karadžić trial until an appropriate medical examination has been conducted determining his ability to testify.

Continuing on the same issue, the Mladić Defence yesterday also filed an urgent motion in its own chamber, asking for an intervention to protect the Accused's rights in relation to the subpoena issued by the Karadžić Chamber. The Defence requests the Chamber not to allow Mladić's testimony pending an appeal and a medical examination, which is to determine if he is fit to stand as a witness.

In the case of Vojislav Šešelj, vice-president Judge Carmel Agius was assigned on Monday to consider the Appeal filed by Mr Šešelj on 10 January 2014 against the Trial Chamber's decision on the continuation of the proceedings. 

Turning now to the courtrooms, the Radovan Karadžić trial will commence again tomorrow at 9:00 in courtroom I and will sit at the same time and courtroom on Friday.

Next week, the Appeals Chamber Judgment in the case of Nikola Šainović and others is scheduled for 23 January at 9:30 in courtroom III. The Media Office will announce accreditation procedures in the coming days for those journalists wishing to attend.

Finally, in the Zdravko Tolimir case a status conference is scheduled for 25 February at 15:00 in courtroom II.

Office of the Prosecutor:

Margriet Prins, Special Adviser to the Prosecutor, made no statement.

Questions:

Asked if there was any indication when the Prosecution’s case would close in the Mladic trial, Prins said that no written notice to close the OTP case has yet been filed, however it was expected by the end of the month.
