ICTY Weekly Press Briefing

Date: 22.06.2005

Time: 12:15

Registry and Chambers:

Jim Landale, Spokesman for Registry and
Chambers, made the following statement:

Good afternoon,

First, as you will have
seen from our press release yesterday,
President Meron will attend the commemoration
of the 10th anniversary of
the Srebrenica genocide in Potocari on
11 July, 2005.

I would also like to
inform you that Judges Agius, Brydensholt
and Eser of Trial Chamber II sitting on
The Prosecutor v. Naser Oric are
currently conducting an on-site visit
to eastern Bosnia. During their visit,
they have and will continue to observe
at first hand sites relevant to the proceedings
in the Srebrenica and Bratunac municipalities.

The Judges have been
accompanied on the visit by the senior
Prosecution trial attorney in the case,
Mr. Jan Wubben, and Mr. Oric’s co-counsel,
Mr. John Jones.

The pre-defence conference
in the Halilovic trial is due to be held
tomorrow at 2.15 p.m. in Courtroom III,
followed by the opening of the Defence
case on Friday at 9 a.m. in the same courtroom
with the Defence opening statement. The
presentation of evidence in the defence
case will commence on 27 June.

There will be a provisional
release hearing in The Prosecutor v.
Ljube Boskoski and Johan Tarculovski
on
30 June at 2.15 p.m. in Courtroom III.
Trial Chamber II has invited representatives
of the Government of the Former Yugoslav
Republic of Macedonia and of the Republic
of Croatia to attend the hearing and to
explain the guarantees given in relation
to Tarculovski and Boskoski respectively.

In the coming week,
status conferences have been scheduled
in The Prosecutor v. Rasevic and Todovic
today at 2.15 p.m. in Courtroom II; in
The Prosecutor v. Milan Gvero and Radivoje
Miletic
on Tuesday 28 June at 11 a.m.
in Courtroom II; in The Prosecutor
v. Rasim Delic
also on Tuesday 28
June at 3 p.m. in Courtroom II (accused
not required to be present).

Office of the Prosecutor:

Jean-Daniel Ruch, Special
Political Advisor to the Prosecutor, made
the following statement:

In the case of Macedonia,
the perspective of receiving four non-indicted
cases back has created some anxieties
in Skopje. Because of the completion strategy,
the Office of the Prosecutor has no choice
but to transfer these cases, for the targets
do not meet the requirements set by the
Security Council. Their future lies solely
within the competence of the domestic
judiciary of the former Yugoslav Republic
of Macedonia. Once the files are transferred,
it will be up to the local authorities
to proceed as they best see fit.

The preparation of these
transfers will still take time, and we
will further discuss the practical modalities
with Skopje.

Questions:

Asked, in relation to
the on-site visit of Trial Chamber II
to eastern Bosnia, if this was an exceptional
visit and what was the purpose of such
a visit, Landale replied that it was not
exceptional for Judges to undertake on-site
visits. He underlined that similar visits
had taken place in a number of other cases,
for instance the Strugar and Blagojevic
& Jokic cases. Their purpose was for
the Judges and representatives of the
Prosecution and Defence to see at first
hand locations relevant to the proceedings.

Asked whether a representative
of the OTP would attend the commemoration
of the 10th anniversary of
the Srebrenica genocide in Potocari since
Carla Del Ponte indicated that she would
not attend, Ruch answered that the Prosecutor
did not exclude her presence, however,
she would not attend if Mladic and Karadzic
were not in The Hague by the 11 of July.
