CASE No. IT-94-1-T / DEFENDANT: Mr. Dusko Tadic. UPDATE-2.
As previously scheduled, the Counsels of the Defendant have filed on Friday 23 June 1995 three preliminary motions:
1) A motion challenging the Jurisdiction of the Tribunal, which is "legally unfounded", of which "primacy over domestic courts is an infringement upon the sovereignty of the States", and which has "no jurisdiction rational material (subject matter jurisdiction) to try any crimes under Articles 2 to 5 of the Statute. These articles fail to determine or describe the offences in such a way that they can serve as an acceptable basis of substantive law to be referred to in the provisions regarding jurisdiction".
2) A motion based on the principle non bis in idem, and which refers to the proceedings in Germany against the Defendant.
3) A motion on the form of the indictment, which is "vague" and consists of "concurrent qualifications".
The Prosecutor has been given by the Trial Chamber II until 7 July 1995 to file its response to the above-mentioned motions.
