TRIAL CHAMBER III ORDERS THE PROVISIONAL RELEASE OF JOVICA STANISIC AND FRANKO SIMATOVIC
On 28 July 2004, Trial Chamber III, consisting of Judge Patrick Robinson presiding, Judge O-Gon Kwon and Judge Bert Swart, ordered the provisional release of Jovica Stanisic and Franko Simatovis under certain specific terms and conditions detailed in the Decision.
The Trial Chamber, in considering whether Jovica Stanisic, if released, would appear for trial, looked at the cooperation of the Accused; the question of voluntary surrender; the seriousness of the crimes charged; the guarantees offered by the governments of Serbia and Montenegro, the Republic of Serbia and the Republic of Montenegro; and the character of the Accused. The Trial
Chamber further considered the possible danger the Accused may pose to victims and witnesses or other persons were he to be provisionally released, as well as his medical condition.
Likewise, the Trial Chamber, in considering whether Franko Simatovis, if released, would appear for trial, looked at the cooperation of the Accused; the question of voluntary surrender; the Accused’s personal guarantee stating his willingness to appear for trial; the seriousness of the crimes charged; and the guarantees offered by the governments of Serbia and Montenegro, the
Republic of Serbia and the Republic of Montenegro. The Trial Chamber further considered the possible danger the Accused may pose to victims and witnesses or other persons were he to be provisionally released.
In both cases, the Trial Chamber was satisfied that, if released, both Accused would appear for trial and that they would not pose any danger to victims, witnesses or other persons.
