Pavle Strugar Granted Provisional Release
The Appeals Chamber earlier today granted temporary provisional release on compassionate grounds to Pavle Strugar. In its order, the Appeals Chamber stated that Strugar’s provisional release should start no later than 17 April 2008 and last for a period of no longer than six days. Strugar is ordered to return to the UN Detention Unit by 21 April 2008.
Strugar’s original request for temporary provisional release, which was filed confidentially, was denied in an Appeals Chamber decision of 2 April. A renewed request was filed confidentially on 9 April.
The accused is a former commander of the Second Operational Group formed by the Yugoslav People’s Army (JNA) to conduct a military campaign against the Dubrovnik region of Croatia. He was convicted of attacks on civilians and destruction or willful damage and sentenced to eight years’ imprisonment on 31 January 2005. Both parties filed appeals to this Judgement. The appeals hearing is scheduled to take place on 23 April 2008.
In its decision granting temporary provisional release, the Appeals Chamber considered the date of the appeals hearing in determining the duration of the provisional release.
