MICO STANISIC, RADIVOJE MILETIC AND MILAN GVERO GRANTED PROVISIONAL RELEASE


Today, 19 July 2005, in three separate decisions, Trial Chamber II consisting of Judges Parker (presiding) Thelin and Van Den Wyngaert granted motions for provisional release for Mico Stanisic, Radivoje Miletic and Milan Gvero, subject to certain specific terms and conditions.


On 19 April 2005, Mico Stanisic filed his motion for provisional release and the Prosecution filed its response on 17 May 2005.


Radivoje Miletic filed his partially confidential motion for provisional release on 25 April 2005 and on 6 May 2005 the Prosecution filed its response to the motion. Milan Gvero filed his motion on 5 April 2005 and the Prosecution filed its response on 19 April 2005.


In coming to its decisions, the Trial Chamber considered whether, if released, the accused would appear for trial and whether the accused would pose a danger to any victim, witness or other person. The Trial Chamber also considered other factors including government guarantees, the gravity of the offenses, the circumstance of the surrender and the degree of cooperation of
the authorities concerned.


In conclusion, the Trial Chamber stated in all three decisions that "the Chamber is persuaded that the Accused has sufficiently demonstrated that he will appear for trial and will not pose a danger to any victim, witness or other person if released. Further, on balance, the Chamber is satisfied that there is justification for exercising its discretion to grant the Accused
provisional release."


The accused will be released in due course.
