Registry and Chambers:

Refik Hodžić, Spokesman for Registry and Chambers, made the following statement:

A group of judges of the Court of Bosnia and Herzegovina, led by the President of the Court, Meddžida Kreso, will visit the Tribunal on Monday and Tuesday next week (February 19 and 20). During the visit they will meet with the President of the ICTY Fausto Pocar and participate in round-table discussions with the ICTY judges on a number of issues relevant to the cases referred by the ICTY.

The topics to be discussed will include the use of evidence obtained by the ICTY in local trials, taking judicial notice of facts proven in other proceedings, retroactive application of substantive law, protection of witnesses, issues concerning detention and provisional release and the right of self-representation.

The visit is organized with the support of the Embassy of United States in Sarajevo.

SCHEDULE:

A status conference will be held in the case of Vojislav Šešelj on 28 February at 9:15 a.m. in courtroom I.

There will be a status conference this week in case against Milan Lukić and Sredoje Lukić tomorrow, 15 February at 15:00 in courtroom I.

The trials for Milutinović et al. and Popović et al. will resume on Monday, 19 February and continue throughout next week as well as the Prlić et al. and the Milošević trials.

FILINGS:

On Monday, a motion was filed by the accused Ante Gotovina requesting an oral hearing to discuss the motion on challenging jurisdiction. In the same case, the defence for Ivan Čermak filed yesterday a submission regarding his provisional release asking for clarification on details of his provisional release.

The Prosecution filed a response to the Trial Chamber’s invitation to reduce the scope of the indictment in the case against Haradinaj et al. declining the Trial Chamber’s invitation. Also in the case, the pre trial briefs for the three accused Haradinaj, Brahimaj and Balaj were filed this week.

The assigned counsel for Krajišnik filed yesterday a notice of appeal asking the appeals chamber to allow the appeal and quash the appellants convictions and order a retrial.

Office of the Prosecutor:

Anton Nikiforov, Advisor to the Prosecutor, made the following statement: The Prosecutor is on her way to Brussels to meet with the Minister of Foreign Affairs of Belgium. She will then travel to Rome to meet with the Italian Minister of Foreign Affairs and will attend a round table discussion at the Swiss Institute "Istituto Svizzero di Roma".

Questions:

A journalist asked whether the Office of the Prosecutor has any comments to make on the recent decision by the European foreign ministers on negotiations with Serbia. Nikiforov replied that it was something the OTP expected and knew it was coming. He added that at this point the OTP was satisfied with the fact that conditionality stays and that the European ministers are waiting for the new government to be established and for it to show concrete results. Nikiforov concluded that the main point for the OTP is that only results matter, not just commitments.
