Good afternoon,
The Tribunal’s Registrar, John Hocking, has been appointed as the Registrar of the International Residual Mechanism for Criminal Tribunals on Tuesday by the United Nations Secretary General Ban Ki-moon. The Registrar will be responsible for the effective commencement of the functions of the Residual Mechanism and for its gradual and smooth take-over of the responsibilities of the ICTY and its sister Tribunal for Rwanda once their mandates have been completed.
Yesterday, a status conference was held in the case of Ratko Mladić. During the hearing, the pre-trial Judge confirmed that opening statements for the trial has been scheduled for 27 March and the next status conferences will be held on 23 February and 7 March.
Turning to the courtroom schedule:
In the contempt trial of Milan Tupajić, the Chamber today granted the Defence’s request to postpone the commencement of trial until 3 February to better prepare for the proceedings. The Defense also announced today it would not have an opening statement nor call on any witnesses. The defense will present its case only through evidence and Mr. Tupajić’s testimony. The Defence assessed this should not take more than 2-3 hours so one trial day should be sufficient.
Proceedings in the case of Mico Stanišić and Stojan Župljanin adjourned Wednesday until further notice pending a decision on future course of trial.
The trial of Zdravko Tolimir adjourned last Tuesday after hearing the testimony of Dragomir Pećanac, who was the last witness to be called by the Prosecution. A total of 126 witnesses testified on behalf of the Prosecution. The defence case will start on Monday, 23 January after the pre-defence conference which will be held at 14:15 in Courtroom III. Tolimir is expected to call a total of four witnesses and his case should last approximately 36 hours.
Also on Monday, the contempt trial of Jelena Rašić, a former member of Milan Lukić’s Defence team who is accused of obtaining false witness statements, will start at 9:00 in Courtroom I.
At 14.30 that afternoon, a Status Conference in the appeals case of Milan and Sredoje Lukić, will be held in Courtroom I.
On Friday, a Status Conference in the appeals case of Ante Gotovina and others will be held at 15:30 in Courtroom III.
Hearings in the trials of Radovan Karadžić as well as Jovica Stanišić and Franko Simatović will continue next week as scheduled.
Proceedings in the Karadžić trial will resume Tuesday at 9:00 in Courtrooom I with the testimony of Mirsada Malagić.
Proceedings in the Stanišić & Simatović trial will also resume on Tuesday at 9:00 in Courtroom II with the testimony of Borislav Pelević.

The documentary depicts the Tribunal’s historic role in the prosecution of wartime sexual violence. The screening will take place at the Humanity House in The Hague on 31 January at 16:00 to be followed with a round table discussion and Q&A session expected to last until 19:00.

Frederick Swinnen, Special Adviser to the Prosecutor, made no statement.
Questions:
Asked for a response to claims by Vojislav Šešelj’s Serb Radical Party in Belgrade that he has been given the wrong therapy and that the Tribunal is attempting to kill him, Jelačić said that she has noted an increased amount of speculative statements made by many individuals and parties in Serbia on this issue. Jelačić said that such claims are absolutely unfounded and that the Registry continues providing the best possible medical care to all of its detainees, including Šešelj.
Jelačić added that in this particular case the Tribunal has been as open and as transparent as possible as far as the Rules and the accused’s own behaviour allowed. Jelačić pointed out that the speed and concrete actions the Registry undertook at the time could be seen in the Registrar’s submission of the timeline to the Trial Chamber. Regarding what happened this week, the actions taken by the Registry were of purely precautionary and preventive nature. Jelačić confirmed that Šešelj was indeed transferred from the Detention Unit to a hospital outside of that complex as a precautionary measure as medical officers wanted a specialist to examine Šešelj. Therefore, Šešelj was transferred very quickly to the civilian hospital where he was examined by the specialists who concluded he was stable and that he did not require hospitalization. He was promptly returned to the DU where he continues receiving the treatment as well as constant care as required by his condition. Unfortunately, more information can not be said about his condition because the accused still refuses to allow the Registry to disclose the details of his medical card, leaving space for the speculations that can be seen in the media.
Asked if this included disclosing information to the Trial Chamber, Jelačić confirmed the Registry was not able to disclose the health status of the accused to the Trial Chamber in this case without his approval.
Asked what the Tribunal’s position was regarding France’s refusal to act on the arrest warrant issued by the Tribunal for Florence Hartmann, Jelačić answered that the Tribunal has not taken a position. It will be up to the Chamber in charge of this case to consider the submission made by the government of France and decide how to proceed.
