Judge Claude Jorda, Président of the ICTY, takes the Oath as a
Member of the International Criminal Tribunal for Rwanda.
Pursuant to Article 14 of the Rules of Procedure and Evidence of the International Criminal Tribunal for Rwanda (ICTR), Judge Claude Jorda, President of the International Criminal Tribunal for the former Yugoslavia (ICTY), on Wednesday 24 November 1999, was sworn in as a member and President of the ICTR Appeals Chamber.
The ceremony took place in The Hague, at the seat of the International Criminal Tribunal for the former Yugoslavia (ICTY). The ICTY Registrar, Ms. Dorothee de Sampayo, witnessed the ceremony on behalf of the United Nations Secretary-General.
Judge Claude Jorda made the following Solemn Declaration:
"I solemnly declare that I will perform my duties and exercise my powers as a Judge of the International Criminal Tribunal for the Prosecution of Persons Responsible for Genocide and other Serious Violations of International Humanitarian Law Committed on the Territory of Rwanda and Rwandan citizens responsible for Genocide and other such violations committed in the territory of neighbouring States, between 1 January 1994 and 31 December 1994, honourably, faithfully, impartially and conscientiously."
This Solemn Declaration was made by Judge Jorda following his election as President of the ICTY. Pursuant to Article 14 of the ICTY Statute, the President of the Tribunal "shall be a member of the Appeals Chamber and shall preside over its proceedings". The Appeals Chamber is common to both International Tribunals but the Judges sit on appeals proceedings either as members of the ICTY or as members of the ICTR. They must accordingly be sworn in for both institutions.
As Judge Jorda has not been called until now to act as a member of the ICTR, he has never made the Solemn Declaration, unlike the other members of the Appeals Chamber. The latter are: Judge Lal Chand Vohrah, Judge Mohamed Shahabuddeen, Judge Wang Tieya and Judge Rafael Nieto-Navia.
