Today, Wednesday 4 August 2004, Duty Judge Inés Weinberg de Roca ordered that Jadranko Prlic, Bruno Stojic, Slobodan Praljak, Milivoj Petkovic, Valentin Coric and Berislav Pusic "remain in the custody of the International Tribunal" until such a time that Trial Chamber decides on the Prosecution’s Motion to stay the orders on the accused’s provisional release issued on 30
July.


BACKGROUND




On 30 July 2004, Trial Chamber I, consisting of Judge Liu Daqun, presiding, Judge Amin El Mahdi and Judge Alphons Orie, ordered the provisional release of the six accused under certain specific terms and conditions detailed in the Decisions (see press release 880). The Accused were to be kept in custody until the necessary arrangements can be made for their travel.


Meanwhile, on Tuesday 3 August, the Prosecutor announced her decision to seek leave to appeal against the provisional release of the six accused, and filed before the Duty Judge a Motion "to stay" the Trial Chamber’s Orders.


The Duty Judge considered that the Prosecution had not applied "for a stay (…) at the time of filing its responses to the initial provisional release applications by each of the six accused", as required by Rule 65 (E) of the Rules of procedure and Evidence, and was now arguing that this Rule "does nor foreclose a separate application for stay being made following a
decision on application for provisional release
". Judge Weinberg de Roca found "that, in the circumstances, it is not appropriate for the Duty Judge, acting as a single Judge, to decide this issue and it is more appropriate for the Trial Chamber to do so".


The Duty Judge accordingly remitted the application to Trial Chamber I for resolution and ordered that the six accused remain in the meantime in the Tribunal’s custody.
