STUDY TOUR OF THE ICTY BY JUDGES AND PROSECUTORS FROM THE SPECIAL COURT FOR WAR CRIMES IN BELGRADE, SERBIA AND MONTENEGRO




During the week of 10-14 May 2004, the Judges and Prosecutors of the Special Court for War Crimes (SCWC) in Belgrade, Serbia and Montenegro conducted a study tour of the ICTY.


The aim of this visit was twofold: to strengthen the channels of communication between the SCWC and the ICTY, and to make use of the legal and practical resources of the ICTY in addressing potential problems in processing war crimes at the SCWC.


In order to achieve these objectives, the SCWC Judges and Prosecutors had an opportunity to meet with their counterparts at the ICTY and discuss many relevant and complex topics related to international criminal law, including the issues of targetting, investigation and charging decisions, methods of proof, and concepts such as command responsibility, joint criminal enterprise,
etc. The crucial issue of cooperation between the SCWC and the ICTY was also discussed. Finally, the Judges and Prosecutors of the SCWC participated in very interesting round table discussions with the Judges and the Prosecutors of the ICTY and attended ICTY court proceedings.


The ICTY welcomed this visit which was sponsored and facilitated by the UNDP/Judicial Training Centre in Belgrade and organised by ICTY Outreach.
