Tadic case : Trial Chamber rejects defence motion on dismissal of charges.

 

Trial Chamber II has rejected the Defence Motion on dismissal of charges against Dusan TADIC, filed on 20 August and argued on 10 September 1996.

In a decision filed on 13 September 1996, the Chamber stated that "the test to be applied (. . .) is whether as a matter of law there is evidence (. . .) as to each count in the indictment which could lawfully support a conviction of the accused."

The Trial Chamber further concluded that: "This is in contradistinction to what will remain for ultimate determination at the conclusion of this trial, namely, the question of fact whether, as to each count and on the whole of the evidence relating to that count, the Trial Chamber is satisfied that guilt has been proved beyond reasonable doubt."
