PROSECUTOR RESPONDS TO THE ACCUSED’S APPEAL

AGAINST THE DECISION ON RELEASE


On 7 November 1997, the Office of the Prosecutor (OTP) filed a Prosecutor’s Response to the Defence Motion for Appeal of the Trial Chamber’s Decision on the Motion for Release by the Accused Slavko Dokmanovi}. The response was filed pursuant to an appeal filed by the Defence requesting the Appeals Chamber to: (i) "modify" the Trial Chamber’s decision not to release
Mr. Dokmanovi}, (ii) to release the accused and, (iii) to return him to his place of residence (see PR 254).


In its response, the OTP states that it is "filing this limited response solely addressing the issue of whether the Defence has raised serious grounds for appellate review of the Trial Chamber’s Decision", as required by Rule 72(B)(ii) of the Tribunal’s Rules of Procedure and Evidence.


The OTP requests the Appeals Chamber to deny the Defence’s application for appellate review, putting forward the following submissions:


1. The arguments alleged in the Defence Appeal Motion do not justify the granting of leave to appeal;


2. The Defence Appeals Motion confines itself exclusively to factual and legal issues which arose before and were conclusively determined by the Trial Chamber;


3. The Defence Appeal Motion fails to state, with any precision, serious grounds for an appeal.


COURTROOM SCHEDULE UPDATE


The Bla{ki} hearing before Trial Chamber I (Judge Jorda, presiding, Judge Shahabuddeen, Judge Riad) on Wednesday 12 November 1997 has been cancelled due to the funeral of Judge Haopei Li.
