INDICTMENT AGAINST ZORAN MARINIC WITHDRAWN


On 3 October 2002, Judge Amin El-Mahdi, issued an Order to withdraw the indictment against Zoran Marinic.


This followed a request by the Prosecution on 29 August 2002, pursuant to Rule 51 of the Tribunal’s Rules of Procedure and Evidence.


In the Order Judge El-Mahdi, considered, inter alia that:



the Prosecutor asserted that, to best use the resources available to her and to fairly and expeditiously prosecute cases, she was compelled to re-evaluate all pending indictments in light of the global strategy of her Office with regard to her investigations and prosecutions. the Prosecutor stated that the accused was a low-level indictee, and as such, no longer corresponded to the
criteria as set out in the strategy of the Prosecutor. it was in the interests of the fair administration of justice and within the framework of the general policy of the International Tribunal, as set out in the Statement of the President of the Security Council on 23 July 2002, that it was more appropriate that the accused be tried before a national court, and the Prosecutor did not
know the whereabouts of the accused and that he was not represented by any counsel known to the International Tribunal.

Judge El-Mahdi ordered that the arrest warrant be withdrawn. In addition, the Judge ordered the Prosecutor to transmit all information related to the case to the competent national authorities, including material supporting the indictment.
