A joint conclusion was that a large number of the Serbian media often cover issues related to the ICTY in a sensationalist manner, often focusing on immediate political goals. Visit of senior legal professionals from Macedonia |

Over a three-day intensive visit, the group gained insight into the work of the Tribunal, by looking at the mandate and jurisdiction of the ICTY, current cases, rules of procedure, analysis of applicable law, defence and detention matters. Much discussion was also generated by the issue of witness protection and investigations. They also met with the ICTY President and Registrar. An Outreach representative gave a lecture on the establishment, jurisdiction and organisation of the ICTY in the Novi Sad School of Journalism. The lecture was part of a special one-day seminar about the Tribunal. Other lecturers came from the Humanitarian Law Center, NIN weekly and representatives of defence counsel working on cases before the Tribunal. After the lecture the Outreach representative gave several interviews to Novi Sad journalists, including a live appearance on Radio 021. Student seminar on the protection of human rights |

A two-day seminar for third-year law students on the protection of human rights in Bosnia and Herzegovina, held at the University of Banja Luka, was attended by an Outreach representative. He gave a brief introduction on the ICTY (establishment, mandate, organisation etc.) which was followed by a one-hour discussion conducted in a lively and constructive atmosphere with many probing questions. Other lecturers included representatives of the Centre for Human Rights, the President of the Constitutional Court of BiH, the President of the Constitutional Court of Republika Srpska (RS) and a RS Constitutional Court judge. This project ensured that a wealth of ICTY-related documents was available in Croatian in the libraries of the Supreme and Constitutional Courts, and in the Office of the President. The Outreach representative participated in a conference for domestic judges and prosecutors in Kosovo, entitled “Extradition and International Legal Assistance in Criminal Matters”. The event offered an overview of international standards in extradition and international legal assistance as well as the implications of these issues in Kosovo in relation to UNMIK. The Kosovo Outreach coordinator lectured about state cooperation with the ICTY including, arrest and transfer of the accused to the Tribunal; assistance in gathering evidence, providing security for witnesses, and primacy of the Tribunal over domestic proceedings. This two-day orientation visit in Zagreb was made by four ICTY judges: judge Richard May, judge Alphons Orie, judge O-Gon Kwon and judge Mehmet Güney. They met with a number of judicial and government officials, from the Ministry of Justice, the State Prosecutor, the Office for Cooperation with the ICTY, the Supreme Court and others. The visit enabled the judges to arrive at a better understanding of the Croatian judiciary, the political climate, domestic war crimes trials and issues in cooperation with the ICTY. Third session in international humanitarian law training for Serbian judiciary |

The third session of the specialised training programme on international humanitarian law for Serbian judiciary was held. This session concluded with a mock trial based on a hypothetical scenario prepared by the Tribunal’s Office of the Prosecutor. A total of six ICTY experts shared their knowledge and experience with their Serbian colleagues. No less than 13 prominent international experts were present at this session. All 35 participants of the programme subsequently made a week-long study trip to the ICTY in January 2002. Visit of senior legal professionals from Kosovo |

The visit offered a comprehensive introduction to the Tribunal and an opportunity to strengthen contacts with the ICTY. Focus was placed on the legal procedures, applicable law, investigations and prosecution, defence and detention. Also, the Kosovo-related cases were analysed, with a special session on the Milošević case. It was the first visit of such high-level officials to the Tribunal, and they also had the opportunity to meet with the ICTY Principals. The participants confirmed how necessary such initiatives were, considering the large knowledge gap on international humanitarian law and the necessity to fill it if war crimes cases were to be successfully tried domestically. The visit took place in the framework of the programme to support the skills and capacity of independent Serbian media to offer the general public balanced information. The Outreach representatives held meetings in Tuzla and Sarajevo, gathering the organisations representing victims from Srebrenica and Podrinje. After a short introduction of the ICTY, a lengthy discussion ensued. Outreach’s newly created information video on the ICTY Justice at Work was screened as well. Panel discussion on facing the past |

An Outreach representative participated in a live two-hour panel discussion on the ICTY, broadcast by Radio 021, the leading local radio of Novi Sad. The other four participants were journalists and NGO activists. After introductory speeches, the audience was engaged in the discussion, which stressed the importance of the Tribunal’s work in facing the war by the FRY society. The ICTY co-organised a panel discussion titled “Hague Tribunal: Law, Morale, Politics”, which gathered six distinguished speakers, including the ICTY Special Adviser to the Prosecutor. Visit of the NGO Women from Srebrenica |

The group represented the families of those killed in Srebrenica in 1995. They were given briefings on the ICTY mandate, cooperation with the states, command responsibility and ICTY cases related to the Srebrenica events. The round table critically reviewed Outreach activities and symposia held in the region to date and examined the ICTY practices to make them more transparent and accessible to the target groups. Conference on command responsibility |

This conference on command responsibility was of high importance for the on-going war crimes-related dialogue in Croatia. This was one of the first professional conferences in Croatia with a high-level academic discussion on the Tribunal. Two ICTY officials, from the Chambers and from the Office of the Prosecutor, spoke at the conference highlighting relevant parts of the ICTY jurisprudence. The key speakers were Professors Leslie C. Green from the University of Alberta (Canada), Ruth Wedgwood from the Yale Law School (USA) and Kai Ambos from the Max Planck Institute (Germany). Experts stressed that command responsibility was not a new concept, discussed the evolution of the doctrine, and implications for military structure, and pondered if a recognized (but not codified) principle was possible to be used in prosecution. Visit of young future leaders from Serbia |

The young Serbian leaders came to the Tribunal to learn more about the institution which they saw currently presented in a mostly negative light by the media. They met with the Outreach, Chambers and Prosecution representatives, who gave short introductions to the Tribunal, and left most of the time for questions. The group was well-prepared with the issues they needed clarification about, and at the end assessed the meetings as helpful in explaining many issues and dispelling some prejudices. The Outreach representative participated in an international conference “Reconciliation – Obstacles and Perspectives” in Herceg Novi. War crimes trials were one of the main topics of the conference, which also served as a platform to promote the book Teško pomirenje (Difficult reconciliation) by Enver Djuliman of the Norwegian Helsinki Committee. The Outreach representative gave a short speech on the Tribunal’s role in the reconciliation process. The first ICTY symposium held in Kosovo |

Kosovo Outreach co-organised the seminar called “The ICTY - facts and models for cooperation”, the first of this kind ever held in Kosovo. The seminar was moderated by the Outreach representative and the ICTY sent four high-level speakers, including the Tribunal Spokesperson, a Victims and Witness expert, and senior advisers from the Office of the Prosecutor and the Registry, giving the Kosovo legal professionals the opportunity to meet and discuss issues directly with experienced ICTY officials. This was especially valuable, as some misinterpretations of the role and the mission of the ICTY prevailing in the Kosovo media tended to influence the opinion of local decision makers as well. The Outreach representative attended a round table discussion on the ICTY organised by a local NGO, in Split, a town known for its public opinion’s negative stance towards the Tribunal’s work. The Outreach representative gave a basic introduction to the Tribunal, after which the floor was open for discussions that lasted for more than two hours. The participants voiced their concern how the Tribunal’s cases reflected on the Croatian Homeland War, and about the ICTY selection of the individuals for prosecution. The event gained a solid media coverage, with several papers carrying some facts about the Tribunal that were rarely mentioned in the Croatian media, and also reporting on some of the criticisms.
